Article 3 Prescribed descriptions of land

(1)

Land which may be included in an area of open land specified in a street litter control notice is land which is part of the premises in respect of which the notice is issued and, subject to paragraph (2) below, land of the following descriptions—

(i)

land which is part of a street, other than a carriageway when it is open to vehicular traffic,

(ii)

relevant land of a principal litter authority, and

(iii)

land under the direct control of any other local authority.

(2)

The land described in paragraph (1)(i) to (iii) may be specified—

(a)

in a street litter control notice issued in respect of premises described in article 2(e) above if the land is within 10 metres of those premises,

(b)

in a street litter control notice issued in respect of any other premises, if the land is within 100 metres of the premises.
