# The Student Fees (Inflation Index) Regulations 2006, Note: Explanatory note

(This note is not part of the Regulations)
Section 26(3) of the Higher Education Act 2004 enables the Secretary of State to specify an index of prices to which she must have regard in deciding whether any increase in the basic and higher tuition fee amounts is no greater than required to maintain the value of the amounts in real terms. These Regulations set out that index. The index is published by the Office of National Statistics and may be found on its website at www.statistics.gov.uk/instantfigures.asp.
The basic and higher tuition fee amounts are prescribed by the Student Fees (Amounts) (England) Regulations 2004 S.I. 2004/1932.
A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
