(This note is not part of the Order)

This Order enables the Minister to make an Order declaring an area within 10 kilometres of a suspected case of swine fever to be a movement restriction area.

When such an Order is made, no person may—

(i)

move any pig off a holding in the area;

(ii)

move any cattle, sheep, goat or other ruminating animal off any holding in the area which has pigs on it; or

(iii)

move any pig out of the area.

The Minister may grant a licence permitting movement, or may direct an officer of the local authority to grant one.

The Order is enforced by the local authority.

Breach of the Order is an offence under the Animal Health Act 1981, punishable on conviction by a fine not exceeding level 5 on the standard scale (currently £5,000).

A regulatory impact assessment has not been prepared for this Order.
