(1) Section 40 is amended as follows.
(2) In subsection (2) omit paragraph (b).
(3) Omit subsection (3).
(4) In subsection (4) for “to (3)” substitute “or (2)”.
(5) In subsection (5) omit paragraphs (a) and (b).
(6) In subsection (6) omit paragraphs (b) and (c).
(7) In subsection (7) omit paragraphs (b) and (c).
