# Trade Marks Act 1994, Paragraph 11: Rights conferred by registered trade mark


Section 9 applies in relation to a comparable trade mark (EU) but as if—
(a) the words in brackets in subsection (3) referring to section 40(3) were replaced with a reference to paragraph 1(4) of this Schedule; and
(b) the proviso in subsection (3) were omitted.
