Article 8 Determination of questions

Any question which arises under any of the provisions of this Order and which is not determined by agreement shall—

(a)

if it is a question arising solely between the Holding Company and the persons administering a railway pension fund, be determined by the Secretary of State, and

(b)

in any other case be determined by a single arbitrator in accordance with the provisions of the Arbitration Act 1950 or any statutory modification or re-enactment thereof for the time being in force.
