Article 4 Amendments to the Tribunal Procedure (First-tier Tribunal) (Property Chamber) Rules 2013

(1)

Rule 13 (costs) of the Tribunal Procedure (First-tier Tribunal) (Property Chamber) Rules 2013^f1 is amended as follows.

In paragraph (1)—

(a)

at the end of sub-paragraph (b) omit “or”; and

(b)

in sub-paragraph (c) at the end insert—

“, or

(d)
in proceedings under Schedule 3A to the Communications Act 2003 (the Electronic Communications Code) which have been transferred from the Upper Tribunal.”.

(3)

After paragraph (1) insert—

“(1A)
An order under paragraph (1)(d) may be made in respect of costs of—

(a)
any part of the proceedings in the Tribunal, and

(b)
any part of the proceedings which took place in the Upper Tribunal before the transfer (subject to any contrary order or direction by the Upper Tribunal).”.
