  "text": "(1) Where an application is made to the relevant planning authority for agreement or approval in respect of a Requirement or any defined stage within that Requirement, a fee of £97 must be paid to it.\n(2) Any fee under this Schedule must be refunded to the undertaker within 4 weeks of—\n(a) the application being rejected as invalidly made; or\n(b) the relevant planning authority failing to determine the application within the time period specified in paragraph 2,\nunless within the period of 4 weeks the undertaker agrees in writing that the fee may be retained by the relevant planning authority and credited in respect of a future application.",
