Regulation 7 Section 56

In section 56(1) (interpretation of Part 1)—

(a)

in the definition of “environmental licence”, both in relation to the Environment Agency and in relation to SEPA^f1—

(i)

in paragraph (aa), insert at the end “, other than regulations made for the purpose of implementing the EU ETS Directive”; and

(ii)

omit paragraph (k); and

(b)

after those definitions, insert—

““the EU ETS Directive” means Directive 2003/87/EC of the European Parliament and of the Council establishing a scheme for greenhouse gas emissions allowance trading within the Community and amending Council Directive 96/61/EC, as amended from time to time;”.
