Explanatory note

(This note is not part of the Order)

The First-tier Tribunal and Upper Tribunal (Chambers) Order 2010 (S.I. 2010/2655) (“the 2010 Order”) organises the First-tier Tribunal and Upper Tribunal into chambers and makes provision for the allocation of those tribunals’ functions between the chambers.

Part 1 of Schedule 3 to the Public Authorities (Fraud, Error and Recovery) Act 2025 (c. 28) inserts a new Schedule 3B to the Social Security Administration Act 1992 (c. 5) (eligibility verification). Part 4 of Schedule 3B provides a new right of appeal for persons who have been given an eligibility verification notice or on whom a penalty has been imposed under Part 2 of Schedule 3B.

Currently, under article 6(c) of the 2010 Order, such appeals are allocated to the Social Entitlement Chamber of the First-tier Tribunal. This Order amends the 2010 Order to reallocate appeals against the exercise by the Secretary of State of functions under Schedule 3B to the Tax Chamber of the First-tier Tribunal.
