Explanatory note
(This note is not part of the Regulations)
These Regulations are the twelfth commencement regulations under the Levelling-up and Regeneration Act 2023 (c. 55) (“the 2023 Act”). They bring section 232 of the 2023 Act (“section 232”) into force. Section 232 amends sections 72A, 107A and 107B of the Marine and Coastal Access Act 2009 (c. 23) (“the 2009 Act”) to confer power on the Secretary of State and the Scottish Ministers, in respect of cases where they are the appropriate licensing authority, to make regulations to charge fees for the monitoring of a marine licence and the variation and transfer of a marine licence. It also amends sections 98, 108 and 110A of the 2009 Act in connection with those new powers. Section 232(9) revokes the Public Bodies (Marine Management Organisation) (Fees) (Order) 2014 (S.I. 2014/2555).
Section 232 is brought into force, with the exception of subsection (9), on the day after the day on which these Regulations are made. Subsection (9) is brought into force on 4th January 2027.
