Explanatory note
(This note is not part of the Regulations)
These Regulations amend the Crime and Policing Act 2026 (Commencement No. 3 and Saving Provisions) Regulations 2026 (S.I. 2026/960 (“the No. 3 Regulations”).
The No. 3 Regulations bring into force a range of provisions in the Crime and Policing Act 2026 (c. 20) (“the Act”) on specified dates.
Regulation 4(f) and (i) of the No. 3 Regulations provide, respectively, that section 6 of and Schedule 3 to the Act will come into force on 26th October 2026. Section 6 introduces a new process for further review of anti-social behaviour case reviews carried out by relevant bodies under section 104 of the Anti-social Behaviour, Policing and Crime Act 2014 (c. 12). Schedule 3 to the Act sets out supplementary provisions, providing more detail as to how case reviews under section 6 are to be carried out, and the procedures to be put in place, including consultation requirements.
Regulation 2 of these Regulations removes regulation 4(f) and (i) from the No. 3 Regulations, meaning that section 6 of and Schedule 3 to the Act will not come into force on 26th October 2026.
These provisions will be brought into force at a future date.
A full impact assessment has not been produced for this statutory instrument. An impact assessment was carried out with regard to the broader package of measures in the Crime and Policing Act 2026, of which the substantive provisions at section 6 and Schedule 3 form part, and to which these commencement and amending regulations relate. It is not envisaged that this amending instrument will have an impact, or at least no significant impact, on the private, voluntary or public sector.
