Explanatory note

(This note is not part of the Regulations)

These Regulations are the fourth commencement regulations under the English Devolution and Community Empowerment Act 2026 (c. 23).

Regulation 2 commences section 12 of the English Devolution and Community Empowerment Act 2026. That section amends section 40 of the Local Government Finance Act 1992 (c. 14), section 107G of the Local Democracy, Economic Development and Construction Act 2009 (c. 20) and section 41 of the Levelling-up and Regeneration Act 2023 (c. 55). The amendments remove the restriction under which precepts could be issued only in respect of mayoral functions. They also preserve the requirement for a separate component in respect of any police and crime commissioner functions exercised by the mayor.
