Regulation 36 Liability of the Commissioners to pay additional statutory paternity pay in cases of legal custody or imprisonmentC1
(1)
Where—
(a)
there is liability to pay additional statutory paternity pay in respect of a period which is subsequent to the last week falling within paragraph (1)(c) of regulation 21, or
(b)
there is liability to pay additional statutory paternity pay during a period of detention in legal custody by virtue of the provisions of paragraph (2) of that regulation,
that liability, notwithstanding section 171ZED of the Act, shall be that of the Commissioners and not the employer.
