In section 108 M1 (exclusion of right: qualifying period of employment) in subsection (3) cases where no qualifying period of employment is required) omit “or” at the end of F1paragraph (p) and F2after paragraph (q) insert—
“or
F3(r)paragraph (1) of regulation 17 of the Agency Workers Regulations 2010 applies.”
