Paragraph 3

The power of the court in section 28(2) to order consideration and adjustment of the liability of a party for the fees of an arbitrator may be exercised by a judge-arbitrator.

Any such exercise of the power is subject to the powers of the Court of Appeal under sections 24(4) and F125(3) (directions as to entitlement to fees or expenses in case of removal or resignation).
