The Secretary of State makes the following Order in exercise of the powers conferred by section 39(2) of the Armed Forces Act 2001f1:

This Order may be cited as the Armed Forces Act 2001 (Commencement No.9) Order 2007.

Section 25 of the Armed Forces Act 2001 shall come into force on 1st January 2008.

Explanatory note

(This note is not part of the Order)

This Order brings into force section 25 of the Armed Forces Act 2001. Section 25 inserts new sections into the Army Act 1955 (c. 18), the Air Force Act 1955 (c. 19) and the Naval Discipline Act 1957 (c. 53). The new sections make provisions equivalent to that provided for in the civilian system by section 2 of the Criminal Procedure (Attendance of Witnesses) Act 1965 (c. 25) for a judge advocate at a court martial to make an order compelling a person not subject to naval, military or air force law to attend court and give evidence.
