Paragraph 43 Crime and Disorder Act 1998
In paragraph 9(5)(b) of Schedule 3 to the Crime and Disorder Act 1998 M1 (procedure where persons sent for trial under section 51)—
(a)
the reference to a service offence includes an SDA offence; and
(b)
the reference to a previous conviction includes, in relation to an SDA offence, a previous finding of guilt in—
(i)
any proceedings under AA 1955, AFA 1955 or NDA 1957 (whether before a court-martial or any other court or person authorised under any of those Acts to award a punishment in respect of any offence); or
(ii)
any proceedings before a Standing Civilian Court.
