Regulation 90 Payment of death benefits to dual capacity memberI1
United Kingdom
This paragraph applies if the deceased member was a dual capacity member of this scheme.
The general rule is that—
benefits are payable in respect of the member under this Part as if 2 or more members of the kinds in question had died (so that 2 or more pensions or lump sums are payable in respect of the one deceased member); and
the amounts payable are determined accordingly.
But that general rule is subject to—
regulation 79 and regulation 80 (lump sum amount payable on death of active member and lump sum amount payable on death of deferred member); and
regulation 81 and regulation 82 (lump sum amount payable on death of pension member and lump sum amount payable on death of pensioner credit member).
If a person who is a pension credit member is entitled to 2 or more pension credits—
benefits are payable in respect of the person under this scheme as if the person were 2 or more persons, each being entitled to one of the pension credits (so that 2 or more pensions or lump sums are payable in respect of the one pension credit member); and
the amounts of those benefits are determined accordingly.
