The Secretary of State, in exercise of the powers conferred upon him by sections 73(2), (3) and (4) and 74(1) of, and paragraph 24 of Schedule 4 to, the Railways and Transport Safety Act 2003^f1, and having consulted in accordance with paragraph 24(7) of Schedule 4 to that Act and a draft of this Order having been laid before Parliament and approved by each House of Parliament, hereby makes the following Order:
