The Secretary of State makes these Regulations in exercise of the powers conferred by section 59(1) and 161(3) of the Health and Social Care Act 2008^f1.

In accordance with section 59(2) of that Act^f2, the Secretary of State has consulted NHS England before making these Regulations.
