Paragraph 5 Interest and recoveryF1
England and Wales
This paragraph applies if all or part of a monetary penalty is unpaid by the time when it is required to be paid.
The unpaid amount of the penalty for the time being carries interest at the rate specified in section 17 of the Judgments Act 1838 (and does not also carry interest as a judgment debt under that section).
The total amount of interest imposed must not exceed the amount of the penalty.
The unpaid amount of the penalty and any unpaid interest may be recovered by the relevant authority as a debt.
