Paragraph 12

England and Wales

In section 9 of the Mental Health Act 1959—

(a)

in subsection (1) for the words “section 38 of the Children and Young Persons Act 1969” there shall be substituted the words “ section 34 of the Child Care Act 1980 ” and for the words “Part II of the Children Act 1948” there shall be substituted the words “ Part III of that Act ” ;

(b)

in subsection (3) for the words “section 1 of the Children Act 1948” there shall be substituted the words “ section 2 of the Child Care Act 1980 ” ;

(c)

in subsection (4) for the words “Children Act 1948” there shall be substituted the words “ Child Care Act 1980 ”.
