Article 16 Provision of care at a school
(1)
A person does not provide day care where the person provides care at a school to a child who has attained the age of 3 and the care provided is incidental to the provision of education.
(2)
In this article, “school” means—
(a)
a maintained school within the meaning of section 39 of the Education Act 2002f1, or
(b)
an independent school.
