Rule 33

In RSC Order 53–

(a)

in rule 3–

(i)

in paragraph (2) omit “without notice being served on any other party”;

(ii)

after paragraph (2) insert–

“(2A)

The documents referred to in paragraphs (2)(a) and (b) need not be served on any other person.”; and

(iii)

in paragraph (3), omit “, and need not sit in public”; and

(b)

in rule 5–

(i)

for paragraph (2) substitute–

“(2)

In any other such cause or matter, the application shall be made to a judge unless the Court directs that it shall be made to a Divisional Court of the Queen’s Bench Division.”; and

(ii)

in paragraph (2A) omit “the issue of a”.
