Article 12 Amendment of Part 61

In rule 61.4—

(a)

in paragraph (7)—

(i)

after “a collision claim”, insert “in personam”;

(ii)

at the end of the paragraph, for the full stop substitute “; or”; and

(iii)

after the last sentence of the paragraph, insert—

“(c)

rule 6.33 applies.”;

(b)

in paragraph (9) for “Part 20 claim”, in each place it appears, substitute “counterclaim”; and

(c)

in paragraph (11)—

(i)

in paragraph (a)(ii), for “in the percentage to which he would have been entitled had the offer been accepted” substitute “in accordance with the apportionment found at trial”; and

(ii)

in sub-paragraph (b)(i), for “in the percentage to which they would have been entitled had the offer been accepted” substitute “in accordance with the apportionment found at trial”.
