Rule 30.8 Transfer of competition law claimsF1

This rule applies if, in any proceedings F2(other than proceedings already in a Competition List of the Business and Property Division, or in the Admiralty Court or Commercial Court of the Business and Property Division at the Rolls Building), a party’s statement of case raises an issue relating to the application F3of Chapter I or II of Part I of the Competition Act 1998 F4or to a claim under section 101 of the Digital Markets, Competition and Consumers Act 2024.

Rules 30.2 and 30.3 do not apply.

The court must transfer the proceedings to the F5Competition List, Admiralty Court or Commercial Court of the Business and Property Division at the Rolls Building.

If any such proceedings F7... fall within the scope of rule 58.1(2), any party to those proceedings may apply for the transfer of the proceedings to the Commercial Court, in accordance with rule 58.4(2) and rule 30.5(3). If the application is refused, the proceedings must be transferred to the F8Competition List of the Business and Property Division at the Rolls Building.
