Section 362BM Issuing a code of practiceF1

(1)

Before issuing a code of practice under section 362BK, OFCOM—

(a)

must publish a draft of the code or (as the case may be) a draft of the revisions of the existing code;

(b)

must consult the following about the draft—

(i)

the Secretary of State;

(ii)

persons who appear to OFCOM to represent providers of internet radio services;

(iii)

persons who appear to OFCOM to represent providers of radio selection services;

(iv)

such other persons as OFCOM consider appropriate;

(c)

may make such alterations to the draft as OFCOM consider appropriate following the consultation.

(2)

Subsection (1) does not apply in relation to revisions of the code of practice if—

(a)

OFCOM give the Secretary of State a draft of the revisions of the existing code, and

(b)

the Secretary of State agrees that it is not necessary for subsection (1) to apply in relation to the revisions.
