Section 170 of the Mines and Quarries Act 1954 (provisions as to references upon notices) is amended as follows.

(2)

In subsection (9) after “Lord Chancellor” insert “ , the Lord Chief Justice ”.

(3)

After subsection (9) insert—

“(10)

The Lord Chief Justice may nominate a judicial office holder (as defined in section 109(4) of the Constitutional Reform Act 2005) to exercise his functions under subsection (9).”
