Section 74 (Minister's power to make orders about pensions) is amended as follows.

In subsection (6)(c) after “Lord Chancellor” insert “ and the Lord Chief Justice of England and Wales ”.

(3)

After subsection (9) insert—

“(10)

The Lord Chief Justice may nominate a judicial office holder (as defined in section 109(4) of the Constitutional Reform Act 2005) to exercise his functions under this section.”
