This paragraph applies where the service of such a notice is appropriate in accordance with Article 59(2) (formal non-compliance) F1or 59A(2) (formal non-compliance in relation to the EU Construction Products Regulation) of the 2011 Regulation, without prejudice to paragraph 2.
