Regulation 27 Offshore CFD unitsI1

This regulation applies where the relevant CFD unit is or is to be an offshore generating station or part of such a station.

The applicant must demonstrate that a lease or an agreement for lease has been granted by the Crown Estate F1Commissioners or a relevant person in respect of the location of the relevant CFD unit.

In this regulation, “offshore generating station” means a generating station which is located wholly in offshore waters F2and “relevant person”, in relation to any property, rights or interests to which section 90B(5) of the Scotland Act 1998 applies, means the person who manages that property or those rights or interests.
