Article 39 Statutory undertakersI1

England and Wales

Subject to the provisions of article 30(2) (compulsory acquisition of rights) and Schedule 12 (protective provisions), the undertaker may—

(a)

exercise the powers conferred by article 28 (compulsory acquisition of land) and article 31 (acquisition of subsoil or airspace only) in relation to so much of the Order land as belongs to statutory undertakers;

(b)

extinguish or suspend the rights of or restrictive covenants for the benefit of, and remove or reposition the apparatus belonging to, statutory undertakers on, under, over or within the Order land.
