Section 52 Amendment of Local Government (Development and Finance) (Scotland) Act 1964.

C1(1)

Section 2(1) of the M1Local Government (Development and Finance) (Scotland) Act 1964 (which relates to the power of local authorities to carry out work on land) shall be amended by adding after paragraph (b) the words

“or
(c)
enabling members of the public to enjoy the countryside or engage in open-air recreation there.”

F1(2A)

For the purposes of section 2(1)(a) and (c) and (2) of the said M2Act of 1964, general and district planning authorities may acquire land compulsorily.

(2B)

For the purposes of section 2(1)(b) of the said Act of 1964, planning authorities may acquire land compulsorily.

(3)

The reference in section 3(2) of the said Act of 1964 (supplementary powers) to the powers conferred by section 2 of that Act shall include a reference to any powers conferred by this Act to carry out work, or provide services or facilities.
