Article 40 Changes to the charge sheet during trial

(1)

If after the commencement of the trial the prosecutor intends to—

(a)

amend, or substitute another charge or charges for, a charge;

(b)

discontinue proceedings on a charge;

(c)

prefer an additional charge;

the prosecutor shall seek the leave of the court.

(2)

Where the court gives leave to discontinue proceedings on a charge, the court may close to consider whether to give the direction provided for in section 52I(13) of the Act.

(3)

Any direction referred to in paragraph (2) above shall be given in open court.
