Article 41 Changes to the charge sheet by the court

Original text. Later amendments are not shown.

(1)

If after the commencement of the trial it appears that there is in the charge sheet—

(a)

a mistake in the name or description of the accused;

(b)

a mistake which is attributable to a clerical error or omission;

the court may amend the charge sheet so as to correct the mistake.

(2)

If at any time during a trial prior to deliberation on the finding on a charge it appears that, with due regard to the fairness to the accused, it is desirable in the interests of justice to amend that charge, the court may do so.
