Rule 14.5 Prosecutor’s representations about bailI1
England and Wales
This rule applies whenever the court can grant or withhold bail.
The prosecutor must as soon as practicable—
provide the defendant with all the information in the prosecutor’s possession which is material to what the court must decide; and
provide the court with the same information.
A prosecutor who opposes the grant of bail must specify—
each exception to the general right to bail on which the prosecutor relies; and
each consideration that the prosecutor thinks relevant.
A prosecutor who wants the court to impose a condition on any grant of bail must—
specify each condition proposed; and
explain what purpose would be served by such a condition.
[Note. A summary of the general entitlement to bail and of the exceptions to that entitlement is at the end of this Part.]
