Article 34 Power to transfer undertakingI1

(1)

The Council may transfer to either LUL or Network Rail (“the transferee”)—

(a)

the authorised works, or any part of them; or

(b)

its right to construct, maintain, use or operate the authorised works (or any part of them) or to acquire or use land for the purpose of the authorised works and such related statutory rights as may be agreed between the Council and the transferee,

on such terms as may be agreed between the Council and the transferee.

(2)

Where an agreement has been made by virtue of paragraph (1)(b) references in this Order to the Council include references to the transferee.

(3)

The exercise of the powers conferred by any enactment by any person in pursuance of any transfer under paragraph (1) is subject to the same restrictions, liabilities and obligations as would apply under this Order if those powers were exercised by the Council.
