The Secretary of State, having consulted in accordance with paragraph 24(7) of Schedule 4 to the Railways and Transport Safety Act 2003^f1, and in exercise of the powers conferred upon him by sections 73(2), (3) and (4) and 74(1) of, and paragraph 24 of Schedule 4 to, that Act, hereby makes the following Order, a draft of which has been laid before Parliament and approved by each House of Parliament:
