Regulation 39 Amendments to paragraphs 3 and 4 of Schedule 22 to the DMCCA: medical prescriptions etc

in sub-paragraph (1)(a) omit “and”;

in sub-paragraph (1)(b)(ii) for “.” substitute “, and”;

after sub-paragraph (1)(b)(ii) insert—

“(c)

is not of an optical appliance.”;

in sub-paragraph (2) in the appropriate place insert—

• ““optical appliance” has the meaning given by section 36(1) of the Opticians Act 1989^f1;”

in sub-paragraph (2), in paragraph (c) of the definition of “prescriber”, for “but as if that definition included “a dentist”;” substitute—

“but as if—

1. (i)

   that definition included “a dentist”, and

2. (ii)

   in paragraph (i) of that definition, “under an agreed clinical management plan” were omitted;”
