Paragraph 16 Other emissions activities: medium combustion plants
Subject to sub-paragraph (4), regulation 7 of the 2018 Regulations does not apply to the operation of an existing medium combustion plant with a rated thermal input equal to or greater than 1 and less than or equal to 5 megawatts until 1 January 2029.
Paragraphs 8, 9 and 11 to 13 of schedule 27 of the 2018 Regulations apply to the operation of an existing medium combustion plant with a rated thermal input equal to or greater than 1 and less than or equal to 5 megawatts on or after 1 January 2030.
An application under the 2018 Regulations to operate an existing medium combustion plant where the rated thermal input of the plant is equal to or greater than 1 and less than or equal to 5 megawatts—
may only be made on or after 28 February 2028, and
must be received by SEPA by 30 June 2028.
Where an application is made in accordance with sub-paragraph (3), regulation 7 of the 2018 Regulations only applies from the date the application is determined.
