Paragraph 7 Environmental Protection Act 1990

For section 33C(1)^f1, substitute—

“(1)

This section applies where—

(a)

subject to subsection (1A) below, a person is convicted of an offence under section 33 above in respect of a contravention of subsection (1) of that section consisting of the deposit or disposal of controlled waste;

(b)

a person is convicted of an offence under regulation 38(1)(a) of the 2007 Regulations in respect of a contravention of regulation 12 of those Regulations consisting of the disposal of waste.”

In section 33C(7)(d), after “section 33 above,” insert “or regulation 38(1)(a) or 38(1)(b) of the 2007 Regulations,”.
