Paragraph 8 Environmental Protection Act 1990

(1)

Section 34^f1 is amended as follows.

(2)

For subsection (1)(aa) substitute—

“(aa)

to prevent any contravention by any other person of regulation 12 of the 2007 Regulations or of a condition of an environmental permit;”.

(3)

In subsection (1)(c)(ii) for “or any condition of a permit granted under regulation 10 of those Regulations” substitute “or regulation 12 of the 2007 Regulations, or a contravention of a condition of an environmental permit,”.

(4)

For subsection (3)(b) substitute—

“(b)

any person who is the holder of an environmental permit in relation to a waste operation;”.

(5)

After subsection (3)(b), insert—

“(ba)

any person who is carrying on an exempt waste operation;”.
