Regulation 36 Amendment of regulation 31 (application of Part 6, reports on overheads and forward planning)

After regulation 31(2) insert—

“(2A)

In determining the value of a qualifying defence contract for the purposes of this Part, any part of the contract the price of which was determined in accordance with a contract pricing method under which costs are indistinguishable from profits (within the meaning of regulation 22(10)(aa)) is to be disregarded.”.
