In section 6(2) of the Education (Miscellaneous Provisions) Act 1953 (payment of tuition and boarding fees for pupils at non-maintained schools)—

(a)

for “the Education Act 1981” there is substituted “ Part III of the Education Act 1993 ”,

(b)

for “not maintained by them or another local education authority” (in both places) there is substituted “ which is not a maintained school ”,

(c)

for “schools maintained by them and schools maintained by other local education authorities” there is substituted “ maintained schools ”,

(d)

for “provided by them” in paragraphs (a)(ii) and (b) there is substituted “ provided ”,

(e)

paragraph (a)(iii) is omitted, and

(f)

at the end there is added— “ and in this subsection “maintained school” means any school maintained by a local education authority and any grant-maintained or grant-maintained special school, and paragraph (b) does not apply where section 190(2) of the Education Act 1993 applies ”.
