Section 38 of the Education Act 1980 (citation etc.) shall be amended as follows.

(2)

Subsections (2) and (4) to (6) are omitted.

(3)

For subsection (3) there is substituted—

“(3)

This Act shall, in its application to England and Wales, be construed as one with the Education Act 1996.”

(4)

In subsection (7), for the words from the beginning to “Northern Ireland;” there is substituted “ In this Act section 20 and this section extend to Northern Ireland, ”.
