Section 112 Power to provide that function of determining eligibility remains with local authorityF1

In section 512A of the Education Act 1996 (c. 56) (transfer of functions under section 512 of that Act to governing bodies), in subsection (4), for paragraph (b) substitute—

“(b)

if the duty corresponds to the one mentioned in subsection (2)(b) or (c)—

(i)

the order may provide that, notwithstanding the other provisions of the order, the function of determining whether pupils at the school fall within section 512ZB(4) is to be exercisable by the local authority, and

(ii)

section 533(3) shall not apply to school lunches or milk provided by the governing body in pursuance of the order.”
