The Department for Employment and Learningf1, in exercise of the powers conferred by Articles 3 and 8(4) of the Education (Student Support) (Northern Ireland) Order 1998f2 and now vested in itf3 and of every other power enabling it in that behalf, hereby makes the following Regulations:

1Citation and commencement

These Regulations may be cited as the Education (Student Support) (Amendment) Regulations (Northern Ireland) 2003 and shall come into operation on 4th April 2003.

2Citation and commencement

The Education (Student Support) Regulations (Northern Ireland) 2002f1 shall be amended in accordance with these Regulations.

3Amendments to the Regulations

(1)

Regulation 12 shall be amended as follows.

(2)

For paragraph (3)(e)(ii) substitute –

“(ii)

a Health Authority or a Strategic Health Authority established pursuant to section 8 of the National Health Service Act 1977f1 or a Special Health Authority established pursuant to section 11 of that Act f2;”

4Amendments to the Regulations

In regulation 21(14) for the words “regulation 12(2)(a) and (b)” substitute “regulation 12(2)(a) or (b)”.

Explanatory note

(This note is not part of the Regulations.)

These Regulations amend the Education (Student Support) Regulations (Northern Ireland) 2002.

The amendment to regulation 12(3)(e)(ii) refers to the new Health Authorities and Strategic Health Authorities established under the National Health Service Reform and Health Care Professions Act 2002.

The amendment to regulation 21(14) corrects a minor drafting error.
