Article 95 Application under section 176A(5) of the 1986 Act to disappply section 176A of the 1986 ActI1

that the application arises in the course of an energy administration;

a summary of the financial position of the protected energy company;

the information substantiating the energy administrator’s view that the cost of making a distribution to unsecured creditors would be disproportionate to the benefits; and

whether any other insolvency practitioner is acting in relation to the protected energy company and if so his address.
