the existing text becomes subsection (1);

in that subsection, in the definition of “travel concession authority”, after paragraph (c) insert—

“(cza)

a combined authority,

(czb)

a combined county authority,”;

after that subsection insert—

“(2)

A county council or a council of a non-metropolitan district is not a travel concession authority for the purposes of this Part where—

(a)

the council is a constituent council of a combined authority or a combined county authority (and here “constituent council” has the meaning given by section 104(11) of the Local Democracy, Economic Development and Construction Act 2009 in relation to a combined authority and section 10(11) of the Levelling-Up and Regeneration Act 2023 in relation to a combined county authority), and

(b)

the combined authority or combined county authority has completed its first full financial year.”
